    Bank of the west uses chex. They opened my account just to close it

    Bank of the west does not offer a fresh start checking, you might got it confused with Wells Fargo. If you are in the chex, and the account does open for some reason, they will close the account and hold your money up to 45 days. If that happens then there is nothing you can do.
